Abstract
Background: Industry payments to orthopedic surgeons, particularly in royalties and licensing, raise concerns about potential conflicts of interest and whether the CMS Open Payments (OP) database accurately reflects these relationships.
Purpose: This study examines the validity of reported industry payments to orthopedic surgeons in the OP database, proposing suggestions to enhance its transparency and utility.
Methods: We conducted a retrospective review of the OP database from August 2013 to December 2023, focusing on the distribution and nature of payments to orthopedic surgeons, particularly those in royalties and licensing.
Results: The data revealed a significant skew in payment distribution and discrepancies between high payments and associated patents.
Conclusion: Our findings highlight the need for more detailed information and better definitions in the OP database to improve its transparency and effectiveness in identifying potential conflicts of interest.
